The console is your property. Microsoft deprives you of the use of your thing through a device ban. That's interference with property - removal and injunction claims apply.

Microsoft must specify: which violation, which clause, automated or manual. 'Code of Conduct violation' without detail is not enough under DSA.

Unfair-terms control

'At sole discretion' suspension clauses are invalid under BGH III ZR 179/20. The procedural triad (hearing, reasons, appeal) applies to Microsoft too.

Minors & in-store purchases

Microsoft Store purchases by minors without parental consent are voidable. A ban over chargeback is itself unlawful - classic lever for family accounts.

What is a device ban?
Microsoft doesn't just ban the account, it ties a console hardware ID. Any account on the device gets banned. That's interference with property and particularly challengeable.
My Game Pass is running - do I get a refund?
Yes. On unlawful suspension you have a pro-rata refund claim for the unused term under §§ 327ff. BGB, plus reinstatement of the library.
What does representation cost?
